Managed Migrations Terms & Conditions

These Managed Migration Terms and Conditions apply to both paid and bundled migrations (free of charge / bundled migrations are only applicable where specifically offered as part of a Web Hosting plan purchased before June 6th 2023, as displayed on the website at the point of purchase and where they are claimed within the initial term of the package (i.e. within the first month, quarter or year, from the date of purchase) and are supplemental to tsoHost’s General Terms and Conditions.

Definitions

In these Managed Migration Terms and Conditions:

‘Basic Migration’ means a migration which does not include migration of a database, as determined in tsoHost’s sole discretion. Basic Migrations are charged at a fixed price, as confirmed by tsoHost to the Customer in writing.

‘Pro Migration’ means any migration that does not constitute a basic migration, as determined in tsoHost’s sole discretion. Pro Migrations are charged on the basis of an hourly rate, as confirmed by tsoHost to the Customer in writing.

Customer Migration Request

The request that tsoHost carry out a migration constitutes acceptance of these Managed Migration Terms and Conditions and tsoHost’s General Terms and Conditions. To initiate a migration request, all data on the migration form displayed in the my.tsohost.com client area must be completed. Once this is done, a support ticket will be raised automatically. tsoHost shall:

(i) evaluate the migration request; (ii) confirm whether the migration is possible, including whether the migration request constitutes a Basic Migration or a Pro Migration; (iii) confirm the price for the migration service; and (iv) provide a suggested migration date/time.

Nothing in these Managed Migration Terms and Conditions obliges tsoHost to fulfil any Customer migration request.

The Customer shall pay any invoice for the migration service within 14 days of the date of tsoHost’s invoice. Should the Customer not make payment within 14 days of the date of tsoHost’s invoice, tsoHost shall not be required to provide the migration service.

Should tsoHost determine that a Basic Migration is indeed a Pro Migration, for example if during the course of the migration, additional complexities arise, tsoHost reserves the right to charge the Customer the costs for the Pro Migration, subject to tsoHost providing reasonable prior notice to the Customer.

tsoHost shall not be obliged to provide any refunds where the Customer has omitted to include material information in the Customer migration request form.

The Customer accepts and understands that tsoHost can only move websites from web hosts where tsoHost has FTP access.

The migration service is the movement of the Customer’s files and databases from their existing host to the tsoHost platform. Sensitive data shared with tsoHost during the migration of your website will be held in compliance with all UK data protection legislation.

tsoHost is not responsible for any loss or damage whatsoever arising from a website migration. Before requesting a migration, Customers must take a full backup of their website data and files.

The Customer accepts and understands that tsoHost will not migrate email, domain registration or custom DNS records. tsoHost will attempt to migrate all databases we believe are necessary for the operation of your website but it is the Customer’s responsibility to ensure that any website functions correctly post-migration.

tsoHost will not migrate an SSL certificate from the Customer’s current provider. If an SSL certificate is required for any migrated websites, then a new one will have to be purchased via tsoHost.

Once a migration is completed, Customers must check that the content has been transferred successfully before cancelling any third-party hosting package. Customers are solely responsible for the decision to terminate any hosting provided by a third-party and tsoHost accepts responsibility for loss of data.

tsoHost will not debug technical issues with a Customer’s website, scripts or databases, whether or not the Customer believe these to have arisen due to the migration. Basic Migrations tsoHost will endeavour to migrate the Customer’s website within 3 working days but the Customer accepts that this response time may be extended during busy periods or due to unforeseen technical issues.

If your DNS is not hosted with tsoHost then it is solely the Customer’s responsibility to update your DNS records. eCommerce Migrations tsoHost will endeavours to migrate the website at the scheduled time however there may be some deviation due to unforeseen technical issues or human factors.
